1. The Agreement
These terms and conditions constitute a binding agreement between Moto-Turismo LLC (“the Company”) and the client named on the booking form.

To confirm a booking, the Company requires:

  • A fully completed and signed booking form, and
  • A deposit of €1,250.

Please note: The booking deposit is strictly non-refundable and non-transferable.

By submitting a booking, the client:

  • Acknowledges acceptance of these general conditions, and
  • Understands and accepts the inherent risks involved in adventure travel.

2. Client Cancellation
i) If the client cancels 30 to 60 days prior to the scheduled departure date, the Company will retain 50% of the deposit (€625).

ii) If the client cancels less than 30 days prior to the scheduled departure date, the full deposit amount (€1,250) will be retained by the Company.

iii) All cancellations must be communicated in writing and will only be considered effective upon receipt by the Company.

3. Company Cancellation
Scheduled group tours require a minimum of five (5) clients to proceed. Each tour will be reviewed one month prior to the departure date.

In the event the Company cancels a tour due to insufficient participant numbers, the client will receive a full refund of all payments made.

4. Client Responsibilities
i) Clients are responsible for ensuring that their passport is valid for the entire duration of their travel.

ii) Clients must obtain all necessary visas, vaccinations, and travel documentation required for the tour.

iii) Clients are responsible for covering all bank charges incurred during payment transfers, including charges from their own bank and any intermediary banks. The Company reserves the right to request reimbursement for any shortfall received.

iv) Clients must comply with the regulations and procedures set forth by police, customs, immigration, and health authorities in the countries visited. The client is solely responsible for any costs, penalties, or delays resulting from failure to comply with such laws, failure to present required documentation, or any actions causing disruption.

v) Each client must respect and acknowledge the authority of the tour leader throughout the duration of the tour.

vi) The tour leader shall not be held liable for any incidents or accidents arising from the client’s imprudent or reckless behavior.

vii) If a client’s health condition or behavior is, in the tour leader’s judgment, likely to compromise the safety, comfort, or enjoyment of the group, the client may be excluded from the tour at any point. In such cases, the client will be responsible for any additional costs incurred, and no refund will be provided.

5. Travel Insurance
i) Comprehensive travel insurance is mandatory for all clients. Coverage must include, at a minimum: trip cancellation, illness, repatriation, and emergency helicopter evacuation.

ii) In the event that the client requires emergency evacuation within Mongolia or to destinations outside Mongolia, all associated costs are the sole responsibility of the client. The Company accepts no liability in such cases.

iii) Clients must ensure that their insurance policy does not contain exclusion clauses that would limit or deny coverage for any activities included in the tour, such as horse riding, mountain biking, or similar adventure sports.

iv) For motorcycle tours, the insurance policy must explicitly cover motorcycle use, which may be classified as an extreme sport by some insurers. Clients must verify that there are no exclusions for riding motorcycles with engine sizes of 500cc or greater.

v) The Company is not responsible for the client’s luggage or personal belongings, whether lost, stolen, or damaged during the tour.

vi) The tour leader shall not be held responsible for any incidents or accidents resulting from the client’s imprudent or negligent actions.

vii) Clients are required to submit a copy of their insurance policy to the Company prior to departure. This must include a 24-hour emergency contact number providing direct access to a human operator authorized to approve emergency helicopter rescue.

6. Currency Exchange Rates
In the event of significant negative currency fluctuations, the Company will absorb the equivalent of the first 2% of any resulting surcharges.

No surcharges will be imposed when payment is made in the advertised currency (EUR) for tour arrangements less than 30 days prior to departure.

7. Age Limits and Fitness
a) Clients are responsible for ensuring they possess the necessary fitness and physical capability to complete the tour itinerary. If in doubt, professional medical advice should be sought prior to booking.

b) Children are not permitted on any part of the tour.

c) Due to the extreme nature of the motorcycle tours, participants must be 18 years of age or older. Individuals under 18 are strictly not allowed to participate.

8. Health and Disability
Clients with any illness, disability, or ongoing medical condition (including those undergoing treatment) must disclose the nature of the condition at the time of booking.

Such clients are solely responsible for arranging their own medications, treatments, and any required medical support during the tour.

Failure to disclose any relevant medical condition constitutes a breach of contract and may result in the client being excluded from the tour, with no refund provided.

9. Changes to the Itinerary
a) The Company reserves the right to modify any aspect of the tour if deemed necessary or advisable. Clients will be notified of any changes prior to departure. If a significant change occurs, clients may cancel their booking within seven (7) days of notification and receive a full refund.

b) In the event of unexpected circumstances affecting client safety (such as broken bridges, impassable roads, epidemics), the Company may alter dates, schedules, or routes as appropriate. Clients acknowledge that no compensation shall be payable in these situations.

c) The Company shall not be liable for refunds if itinerary changes are required due to events beyond its control, including but not limited to: threats of war, riots, civil unrest, strikes, legal or political restrictions, force majeure, technical issues, airline decisions, or other uncontrollable circumstances, unless negligence on the part of the Company is proven.

d) Once the tour has commenced in Mongolia, the itinerary will only be changed for health reasons or serious emergencies.

e) Should a client’s return to Ulaanbaatar be delayed due to reasons beyond the Company’s control, resulting in a missed international departure, the client will be responsible for all related costs. The Company will assist in providing any necessary documentation for insurance reimbursement purposes.

10. Utilization of Camping Gear
i) Clients must return all Company-owned equipment in the same condition as at the start of the tour.

ii) Any defects or damage noticed in the equipment at the beginning of the tour must be reported to the tour leader immediately. Failure to report pre-existing defects will result in the client being held responsible for any damages and required to pay appropriate compensation.

iii) Clients are responsible for using all equipment safely and responsibly. The use of smoking materials, candles, or petrol lamps inside tents is strictly prohibited. Cooking gear and accessories must not be left outdoors near tents overnight.

iv) If any equipment is lost or stolen, the client must compensate the Company for its full replacement value.

11. Motorcycle Rental Conditions

i) The motorbike equipment, including all accessories, is provided on hire and remains the property of Moto-Turismo LLC (“the Owner”). The motorcycles, accessories, and spare parts are genuine Fantic products imported from Italy.

ii) As the Owner’s property, the client (“the Renter”) must not sell, rent out, transfer, or allow any other person to operate the assigned motorcycle or use the equipment.

iii) The Renter must hold a valid motorcycle-endorsed driver’s license and provide a copy upon making the reservation.

iv) Upon arrival in Mongolia, the Renter shall pay a security deposit of €1,000 to the Tour Leader to cover potential damages. This deposit is fully refundable, provided the motorcycle is returned without damage. Minor scratches and normal wear and tear (including wear on tires, chain, sprocket, brakes, clutch, and bearings) will not result in deductions. Any accidental damage will be assessed, and repair costs estimated. Genuine Fantic spare parts will be charged at retail price plus DHL shipping if immediate delivery is required.

v) The Renter must not modify the motorcycle, except for adjusting the foot brake lever or raising the handlebars. The original factory settings must remain unchanged.

vi) The Renter is responsible for the proper use and care of the motorcycle and must return it, with all accessories, in the same condition it was received.

vii) If the Renter travels off the main track without explicit permission from the Tour Leader, they assume full responsibility for any resulting damage, including tire punctures.

viii) Any damage to the motorcycle during the rental period will be charged to the Renter by the Owner.

ix) The Renter must promptly inform the Tour Leader of any required repairs or adjustments upon arrival at camp each evening.

x) In the event of a mechanical breakdown beyond the control of either party, the Owner will make every reasonable effort to enable the Renter to continue the tour.

xi) The Renter shall be liable for all costs, claims, expenses, or demands arising directly or indirectly from the use of the motorcycle during the rental period. The Owner reserves the right to charge the Renter for partial or full settlement of such claims.

xii) While in use, the Renter must ensure the motorcycle is properly secured. The Owner assumes responsibility for the motorcycle’s security after riding hours. If the motorcycle is stolen due to the Renter’s negligence, the Owner reserves the right to seek compensation for the replacement value and shipping costs from the EU to Mongolia.

xiii) The Renter must not operate the motorcycle under the influence of alcohol or drugs under any circumstances.

12. Additional Guidelines

a) Moto-Turismo Mongolia is committed to providing a positive experience for all participants during off-road motorcycle tours. As these tours are not competitions or races, reckless or dangerous riding will not be tolerated. All participants are expected to respect Mongolia’s culture, nature, and people.

b) Our responsibility is to traverse Mongolia without harming its pristine environment or disrupting the local population and their animals. Some routes pass through protected areas where flora is legally safeguarded. Actions such as abrupt braking or wheel spinning are discouraged, as they may damage the environment and harm the Company’s reputation. Upon arrival at camp, the riding day ends, and participants should refrain from requesting to use the bikes to explore the surrounding area.

c) Most roads traveled are unpaved but follow clear trails. Deviating from designated trails risks environmental damage and harm to motorcycles. Areas inhabited or formerly inhabited by nomadic families may contain debris such as metal or bones, which can puncture tires. Additionally, venturing off-trail to areas inaccessible by support vehicles can impede rescue efforts in case of accidents.

d) All riders must follow the instructions of the TOUR LEADER. Mongolian roads often form a complex network of splits and re-joins, making it impractical to describe every possible route in advance. At river crossings, all riders must stop and regroup with support vehicles. If water depth is deemed unsafe, motorcycles will be transported on trailers or alternate routes chosen. No rider should attempt a river crossing alone.

e) Due to variable weather and conditions, trails may change yearly. Bridges may collapse, rivers may flood, and roads may become impassable. Participants should avoid repeatedly questioning the Tour Leader and drivers about trail conditions. The Company will make every effort to adhere to the planned itinerary.

f) The Company will provide petrol for the motorbikes, included in the tour price. Riders are responsible for informing the Tour Leader when their tank requires refilling. Simultaneous refilling of all bikes on the trail may cause delays.

g) Mongolia enforces a strict zero-tolerance policy regarding alcohol. Excessive drinking the evening before the tour start is prohibited. Authorities in Ulaanbaatar monitor this closely, and riders testing positive for alcohol may have their motorbikes confiscated.

h) Until the end of the tour, the assigned motorcycle is under the rider’s care. It is strictly prohibited to allow local individuals to sit on or ride the bike.

i) Mongolia offers an exceptional environment for off-road riding and a unique opportunity to experience the nomadic lifestyle of Central Asia. To ensure the smooth operation of our tours, all participants must adhere to these guidelines and comply with the Terms & Conditions.

13. Jurisdiction

Any dispute arising between the Client and the Company shall be subject to the exclusive jurisdiction of the courts of Mongolia.
